LIQUOR ACT 2007 - SECT 114O
Self-exclusion
114O Self-exclusion
(1) A person (the
"participant" ) may ask a same day delivery provider to enter into an
agreement (a
"self-exclusion agreement" ) with the participant under which the participant
agrees to be prevented from having liquor delivered by the
same day delivery provider to the participant.
(2) A self-exclusion agreement
must comply with the requirements prescribed by the regulations.
(3) The
same day delivery provider must-- (a) enter into a self-exclusion agreement
with the participant, and
(b) comply with the agreement.
: Maximum
penalty--30 penalty units.
(4) If a same day delivery provider sells or
advertises liquor through an internet site or by other electronic means for
same day delivery, the provider must ensure that-- (a) the internet site or
other electronic means provides a way for a person to enter into a
self-exclusion agreement with the provider, and
(b) any person accessing the
internet site or other electronic means would reasonably be expected to be
alerted to the ability to enter into a self-exclusion agreement.
: Maximum
penalty--30 penalty units.
(5) No civil or criminal liability is incurred by
the same day delivery provider for an act done, or omitted to be done, in good
faith and in accordance with this section, in relation to the participant.
