PROBATE AND ADMINISTRATION ACT 1898 - SECT 67
Order may be made to assign the bond
67 Order may be made to assign the bond
(1) The Court may, on being satisfied that the condition of any bond given
hereunder has been broken, order the Registrar, for and on behalf of Her
Majesty, to assign the same to some person to be named in such order.
(2)
Such person the person's executors or administrators shall thereupon be
entitled to sue upon the said bond in the person's or their own name or names
as if the same had been originally given to the person, and shall be entitled
to recover thereon as trustee for all persons interested the full amount
recoverable in respect of any breach of the condition of the said bond.
