Payments in respect of children
43 Payments in respect of children
(1) A pension payable under this Act in respect of a child shall be paid to
the child’s mother, if living, or, if she is not living, to the child’s
father, if living.
(2) Notwithstanding anything elsewhere contained in this
Act, any money payable out of the Fund under this Act in respect of a child
may, at the discretion of STC, be paid to the child’s guardian or expended
by STC for the benefit of the child.
(3) Not more than one pension may be
paid in respect of the one child during any one period and where, but for this
subsection, pensions would be payable, in respect of the child, of the
appropriate amount per fortnight under both section 61M and section 61N, the
pension payable shall be that of the appropriate amount per fortnight under
section 61N.
