The Legislative Assembly of the Northern Territory enacts as follows:
This Act may be cited as the Learners and Provisional Drivers Legislation Amendment Act 2006.
PART 2 – AMENDMENT OF MOTOR VEHICLES ACT
This Part amends the Motor Vehicles Act.
Section 5(1)
insert (in alphabetical order)
"provisional licence" means a licence granted under section 10 because of section 10A;
Section 10A(2)
omit, substitute
(2) A provisional licence granted to a person remains provisional for a period of:
(a) one year if the person is at least 25 years old when granted the provisional licence; or
(b) 3 years if the person is less than 25 years old when granted the provisional licence.
(3) A provisional licence must not be granted to a person unless the person:
(a) has driven a motor vehicle as a learner in accordance with regulation 12 of the Traffic Regulations for at least a total of 120 hours in the 12 months immediately preceding the application for the licence; and
(b) has maintained a record of those hours in the approved form; and
(c) has given a copy of the record to the Registrar.
(4) Subsection (3) does not limit the matters that must be taken into account in granting a provisional licence.
(5) Without limiting what must be included in the record, the record must be certified by each licence holder occupying a front seat of the vehicle driven by the person when accumulating those hours.
(6) In this section:
"licence holder" means a person who:
(a) is at least 18 years of age; and
(b) holds a licence other than a permit licence mentioned in section 9 or a provisional licence.
PART 2 – AMENDMENT OF TRAFFIC REGULATIONS
This Part amends the Traffic Regulations.
After regulation 12(10)
insert
(11) A learner must not drive a vehicle that is towing another vehicle.
After regulation 14(3)
insert
(4) A provisional driver must not drive a vehicle that is towing another vehicle.
(5) A provisional driver must not, at any time between 10 pm at night and 5 am in the morning, drive a vehicle that is occupied by more than one other person.
