1994 A BILL FOR An Act to amend the Anti-Discrimination Act 1991, and for related purposes

 


 

s1 4 s6 Anti-Discrimination Amendment The Parliament of Queensland enacts-- 1 title 2 Short 1. This Act may be cited as the Anti-Discrimination Amendment Act 3 1994. 4 5 Commencement 2. This Act commences on 1 July 1994. 6 amended 7 Acts 3. This Act amends the Anti-Discrimination Act 1991 and the Acts 8 mentioned in the Schedule. 9 of s 4 (Definitions) 10 Amendment 4. Section 4-- 11 insert-- 12 ` "forced retirement" includes engaging in conduct with a view to causing 13 a person to retire from particular work because of the person's age;'. 14 of s 14 (Discrimination in the pre-work area) 15 Amendment 5. Section 14(1)(c)-- 16 omit, insert-- 17 `(c) in the terms of work that is offered, including, for example, a 18 term about when the work will end because of a person's age; 19 or'. 20 of s 15 (Discrimination in work area) 21 Amendment 6. s7 5 s8 Anti-Discrimination Amendment insert-- 1 `(3) In this section-- 2 "dismissing" includes ending the particular work of a person by forced 3 retirement, failure to provide work or otherwise.'. 4 of s 32 (Compulsory retirement age) 5 Replacement 7. Section 32-- 6 omit, insert-- 7 age for partners 8 `Retiring `32.(1) It is not unlawful in deciding who should be invited to become a 9 partner in a partnership for a person to discriminate on the basis of age 10 against someone else through a requirement that the other person-- 11 (a) must not be more than a specified age; or 12 (b) must retire from a partnership at a specified age. 13 `(2) It is not unlawful in any variation of the terms of a partnership for a 14 person to discriminate on the basis of age against someone else through a 15 requirement that the other person-- 16 (a) must not be more than a specified age; or 17 (b) must retire from a partnership at a specified age. 18 `(3) This section has effect despite section 291(2)(b)(iv) of the Industrial 19 Relations Act 1990.'. 20 of s 64 (Application of Commonwealth occupational 21 Amendment superannuation standard) 22 8. Section 64, `Occupational Superannuation Standards Act 1987 of the 23 Commonwealth'-- 24 omit, insert-- 25 `Occupational Superannuation Standards Act 1987 (Cwlth) or 26 Superannuation Industry (Supervision) Act 1993 (Cwlth)'. 27

 


 

s9 6 s 10 Anti-Discrimination Amendment of s 65 (Compliance etc. with Commonwealth legislation) 1 Amendment 9. Section 65(a)-- 2 omit, insert-- 3 `(a) to comply with a Commonwealth Act (other than the 4 Occupational Superannuation Standards Act 1987 or 5 Superannuation Industry (Supervision) Act 1993); or'. 6 of new s 106A 7 Insertion 10. After section 106-- 8 insert-- 9 retirement age under legislation etc. 10 `Compulsory `106A.(1) This Act has no effect on the imposition of a compulsory 11 retirement age on-- 12 (a) a Supreme Court Judge; or 13 (b) a District Court Judge; or 14 (c) a Magistrate; or 15 (d) a member of the Land Court; or 16 (e) the President of the Industrial Court; or 17 (f) an Industrial Commissioner under the Industrial Relations Act 18 1990; or 19 (g) the Commissioner of Fire Service; or 20 (h) a fire officer within the meaning of the Fire Service Act 1990; or 21 (i) the chief executive of Queensland Railways; or 22 (j) an employee of Queensland Railways; or 23 (k) a police officer; or 24 (l) a staff member within the meaning of Statute No. 14 (Staff 25 tenure) made under the University of Queensland Act 1965 while 26 provisions under the Statute about compulsory retirement age are 27 in force; or 28 (m) a director of a public company or subsidiary of a public company; 29

 


 

s 11 7 s 11 Anti-Discrimination Amendment or 1 (n) another person prescribed by regulation. 2 `(2) Subsection (1) applies if the compulsory retirement age is imposed 3 on or before 30 June 1994 under-- 4 (a) an Act; or 5 (b) an award, certified agreement, enterprise flexibility agreement or 6 industrial agreement within the meaning of the Industrial 7 Relations Act 1990; or 8 (c) a policy, standard or other instrument of a unit of the public sector 9 applying to an employee of the unit. 10 `(3) If the compulsory retirement age is imposed under something 11 mentioned in subsection (2)(b) or (c), then, by force of this subsection, a 12 person mentioned in subsection (1) is required, and is taken always to have 13 been required, to retire in accordance with the compulsory retirement age 14 imposed.'. 15 of s 267 (Regulations) 16 Replacement 11. Section 267-- 17 omit, insert-- 18 19 `Regulations `267.(1) The Governor in Council may make regulations under this Act. 20 `(2) A regulation may make provision about-- 21 (a) the exercise of the Commissioner's powers; and 22 (b) the Tribunal's procedure; and 23 (c) the fees to be paid for making a complaint under Chapter 7 24 (Enforcement); and 25 (d) costs; and 26 (e) the fees and expenses to be paid to a person appearing as a 27 witness in a proceeding under the Act. 28 `(3) A regulation may provide that contravention of a regulation is an 29

 


 

s 12 8 s 12 Anti-Discrimination Amendment offence and prescribe a maximum penalty for the offence of not more than 1 20 penalty units.'. 2 of new s 268 3 Insertion 12. After section 267-- 4 insert-- 5 provisions about compulsory age retirement 6 `Transitional `268.(1) Subject to section 106A (Compulsory retirement age under 7 legislation etc.), a provision of-- 8 (a) a previous industrial order; or 9 (b) a previous industrial agreement; or 10 (c) a previous public sector policy; 11 is of no effect so far as it requires, or requires or authorises the compelling 12 of, a worker to retire on or after reaching a particular age. 13 `(2) If a compulsory retirement age is-- 14 (a) set for a person on or before 30 June 1994 under section 32(1) 15 (Compulsory retirement age) as in force on that day; or 16 (b) specified for a person under a previous agreement; 17 then, by force of this subsection, the person is required, and is taken always 18 to have been required, to retire in accordance with the compulsory 19 retirement age set or specified unless the compulsory retirement age is 20 subsequently waived by the relevant parties. 21 `(3) Subject to section 106A, a previous provision of an Act is of no 22 effect so far as it has the effect, apart from this subsection, of disqualifying, 23 or requiring or authorising the disqualification of, a person from applying 24 for or being appointed to an office or position or other work because the 25 person has reached a particular age. 26 `(4) Subject to section 106A, a previous provision of an Act is of no 27 effect so far as it requires, or requires or authorises the compelling of, a 28 person to end work on or after reaching a particular age. 29 `(5) Subsections (1), (3) and (4) have effect despite section 106 (Acts 30 done in compliance with legislation etc.). 31

 


 

s 13 9 s 13 Anti-Discrimination Amendment `(6) In this section-- 1 "previous agreement" means any agreement in existence on 30 June 1994 2 other than a previous industrial agreement; 3 "previous industrial agreement" means a certified agreement, enterprise 4 flexibility agreement or industrial agreement within the meaning of the 5 Industrial Relations Act 1990 in force on 30 June 1994; 6 "previous industrial order" means an order or award of a court or 7 tribunal having power to fix minimum wages and other terms of 8 employment in force on 30 June 1994. 9 "previous provision of an Act" means a provision of an Act in force on 10 30 June 1994; 11 "previous public sector policy" means a policy, standard or other 12 instrument of a unit of the public sector applying to an employee of the 13 unit in force on 30 June 1994.'. 14 15 Repeal 13. The Public Office (Age Qualification) Act 1985 is repealed. 16 17
