ANIMAL CARE AND PROTECTION ACT 2001 - SECT 158

158 Application of div 5
(1) This division applies if an inspector reasonably believes— (a) a person
has committed, is committing, or is about to commit, an animal welfare
offence; or
(b) an animal— (i) is not being cared for properly; or
(ii) is
experiencing undue pain; or
(iii) requires veterinary treatment; or
(iv)
should not be used for work; or Example for subparagraph (iv)— A horse with
‘saddle sore’ should not be used by a riding school.
(c) a person has
not complied with a compulsory code requirement.
(2) This division also
applies if an animal has been seized under division 4 , subdivision 1 .
