160 Requirements for giving animal welfare direction
(1) An animal welfare direction must— (a) be in the approved form; and
(b)
describe— (i) the animal in a way that reasonably allows the person given
the direction to identify it; or
(ii) if the direction is given because the
inspector reasonably believes a person has committed, is committing or is
about to commit, an animal welfare offence—the type of animal to which the
offence relates; or
(iii) if the direction is given because the inspector
reasonably believes a person has not complied with a
compulsory code requirement—the particulars of the non-compliance; and
(c)
state— (i) each requirement; and
(ii) a time for the person to comply with
each requirement; and
(d) include an information notice about the decision to
give the direction.
(2) Despite subsection (1) (a) , an animal welfare
direction may be given orally if— (a) the inspector considers it to be in
the interests of the animal’s welfare to give the direction immediately; and
(b) for any reason it is not practicable to immediately give the direction in
the approved form; and
(c) the inspector gives the person an offence warning.
(3) If the direction is given orally, the inspector must confirm the direction
by also giving it in the approved form as soon as practicable after giving it
orally.
(4) An animal welfare direction may state that an inspector proposes,
at a stated time or at stated intervals, to enter the following where an
animal the subject of the direction is kept at to check compliance with the
direction— (a) a vehicle of which the person is the person in control;
(b)
another place of which the person is the occupier.
