ANIMAL CARE AND PROTECTION ACT 2001 - SECT 178

178 Offences under Act are summary

(1) An offence against this Act is a summary offence.

(2) A proceeding for the offence must start within the later of the following periods to end—

(a) 1 year after the commission of the offence;

(b) 6 months after the offence comes to the complainant’s knowledge, but within 2 years after the commission of the offence.

(3) A prosecution may only be started by a person authorised by the chief executive to bring the prosecution.
