It is an offence exemption for an offence if—
(a) the act that constitutes the offence involves the use of a live creature as follows for bait or as a lure to take, or attempt to take, fish—(i) a fish;(ii) an invertebrate of a species from the class Cephalopoda or Malacostraca; and
(b) the fishing or attempted fishing complies with any conditions prescribed under a regulation.
