Queensland Consolidated Acts Queensland Consolidated Acts(1) Where there is now or hereafter pending in a Magistrates Court an action, the plaintiff may at any time apply to the District Court for an order to transfer the action to the District Court on the ground that there is reasonable ground for supposing that the relief or remedy sought (which would be available if the action were transferred to the District Court) is not available in the Magistrates Court.
(2) If, on any such application the judge is satisfied that there is reasonable ground as aforesaid, the judge shall make an order that the action be transferred to the District Court.
