Court may order books of account or copies to be made available
88 Court may order books of account or copies to be made available
(1) On the application of any party to a proceeding, a court may order that
such party be at liberty to inspect and take copies of or extracts from any
entries in a book of account of any undertaking for any of the purposes of
such proceeding.
(2) An order under this section may be made either with or
without summoning the person engaged in the undertaking or any other party and
shall be served on the person engaged in the undertaking 3 clear days before
the same is to be obeyed unless the court otherwise directs.
(3) An order
under this section may direct that the person engaged in the undertaking
shall, on payment of such fee as is specified in the order, prepare and
deliver to the party who obtained that order a duly verified copy of such
entries as may be required for evidence in the proceeding.
(4) For the
purposes of subsection (2) , Saturday, Sunday, and any day which is a public
holiday throughout the State or in that part of the State in which the order
is to be obeyed shall be excluded from the computation of time.
(5) Where a
person engaged in any undertaking is a party to a proceeding, the other party
or parties thereto shall be at liberty to inspect and make copies of or
extracts from the original entries and the accounts of which such entries form
a part and the documents in respect of which such entries were made as though
this division had not been enacted.
