This Act may be cited as the Eagle Farm Racecourse Act 1998. ÷Commencement 2. This Act commences on 1 April 1998. ÷Definitions 3. In this Act- "QTC Ltd" means Queensland Turf Club Ltd ACN 079 598 235. "repealed Act" means the Eagle Farm Racecourse Act 1993. "trustee" means a person who was a trustee under the repealed Act immediately before the commencement of this Act. "trust land" means land that was trust land under the repealed Act immediately before the commencement of this Act. "trust property" means property that was trust property under the repealed Act immediately before the commencement of this Act. ÷Abolition of trust 4. The trust established under the repealed Act (the "trust") is at an end. s 5 Eagle Farm Racecourse Act 1998s 8 s 5 Eagle Farm Racecourse Act 1998s 8 ÷Vesting of trust property and other assets and liabilities 5.(1) The trust property, including the trust land, is transferred to, and vests in, the QTC Ltd. (2) Any other asset or liability of the trustees is transferred to, and vests in, the QTC Ltd. (3) If, immediately before the commencement of this Act, the trust property or another asset of the trustees was subject to an interest (a "non-trust interest"), other than an interest under the trust, the trust property or asset is transferred, and vests, subject to the non-trust interest. (4) A transfer of a liability under subsection (2) discharges the trustees from the liability. ÷Lodgement of transfer for registration 6. The QTC Ltd must lodge an instrument of transfer for the trust land with the registrar of titles for registration. ÷Limitations on dealing with and using trust land 7.(1) The trust land must not be sold without the Minister's prior written consent. (2) A sale in contravention of subsection (1) is of no effect. (3) The trust land must be used for the purposes of a racecourse. (4) However, all or part of the trust land may be used for another purpose with the Minister's prior written approval. ÷Proceedings by or against trustees 8.(1) This section applies if, immediately before the commencement of this Act, a proceeding might have been continued or started by or against the trustees in their official name in relation to an asset or liability that is transferred to the QTC Ltd under this Act. (2) The proceedings may be continued or started by or against the QTCLtd. (3) The QTC Ltd has the same rights, privileges and liabilities in relation s 9 Eagle Farm Racecourse Act 1998s 10 s 9 Eagle Farm Racecourse Act 1998s 10 to the proceedings as the trustees would have had if there had been no transfer. (4) A document that could have been given in evidence by or against the trustees if there had been no transfer may be given in evidence by or against the QTC Ltd. ÷Transitional references to trustees 9. In an Act or other document, a reference to the trustees or the Trustees of Eagle Farm Racecourse may, if the context permits, be taken to be a reference to the QTC Ltd. ÷Repeal of Eagle Farm Racecourse Act 1993 10.(1) The Eagle Farm Racecourse Act 1993 is repealed. (2) This section expires the day after it commences. This provision has expired and is included in this reprint for informational purposes only. It will be omitted in the next reprint.
