INDUSTRIAL RELATIONS ACT 1999 - SECT 76

76 Arbitration when conciliation unsuccessful

If the commission considers all reasonable attempts to settle an application by conciliation have been made, but have been unsuccessful, the commission may hear and decide the application by—

(a) making an order under section 78, 79 or 80; or
(b) dismissing the application.
