Queensland Consolidated Acts Queensland Consolidated Acts(1) Subject to section 6, if at any time a commissioned officer (the emergency commander) is satisfied on reasonable grounds that an emergency situation has arisen or is likely to arise the commissioned officer may declare that an emergency situation exists in respect of an area specified by the commissioned officer.
(2) The emergency commander, as soon as practicable after he or she declares that an emergency situation exists, shall issue a certificate to this effect signed by the emergency commander which certificate shall set out the nature of the emergency situation, the time and date it was declared to exist and the area in respect of which it exists.
(3) The declaration that an emergency situation exists shall continue until revoked by the emergency commander or, if the emergency commander is unavailable, another commissioned officer of the same or more senior rank.
(4) The emergency commander or, if the emergency commander is unavailable, another commissioned officer of the same or more senior rank, shall as soon as practicable thereafter, note the time and date of the revocation on the certificate issued pursuant to subsection (2).
(5) The certificate issued in respect of an emergency situation shall be forwarded to the office of the Commissioner of the Police Service within 14 days of the revocation of the declaration of the emergency situation and shall be held in that office for a period of at least 6 years.
