RADIATION SAFETY ACT 1999 - SECT 103E
When chief executive must give a person details of information received about the person
103E When chief executive must give a person details of information received
about the person
(1) This section applies to information about a person received by the chief
executive under sections 103B , 103C or 103D .
(2) Before using the
information to make a decision under this Act the chief executive must give
written notice to the person stating— (a) details of the information
received; and
(b) that the person may, within a stated period of not less
than 28 days, make representations to the chief executive about the
information.
(3) However, subsection (2) does not apply if under a law of the
Commonwealth— (a) the person has already been given the opportunity to make
representations about the information; or
(b) a decision has been made that
the information should not be given to the person because it would be
prejudicial to the interests of national security.
