RIGHT TO INFORMATION ACT 2009 - SECT 106

106 Restrictions under other laws not applicable
(1) No obligation to maintain secrecy or other restriction on the disclosure
of information obtained by or given to agencies or Ministers, whether imposed
under an Act or a rule of law, applies to the disclosure of information to the
information commissioner for the purposes of an external review.
(2) Legal
professional privilege does not apply to the production of documents or the
giving of evidence by a member of an agency or a Minister for the purposes of
an external review.
(3) Subject to subsections (1) and (2) , every
participant in an external review has the same privileges in relation to the
giving of evidence and producing documents and things that the person would
have as a witness in a proceeding before a court.
