South Australian Consolidated Acts17—Non-compliance with bail agreement constitutes offence
(1) A person who,
without reasonable excuse, contravenes or fails to comply with a term or
condition of a bail agreement is guilty of an offence.
Maximum penalty: $10 000 or imprisonment for 2 years.
(2) A penalty imposed
under this section must not exceed the maximum penalty that may be imposed for
the principal offence.
(3) A penalty imposed
under this section is in addition to any pecuniary forfeiture that the
convicted person suffers or may suffer in consequence of the offence.
(4) A reference in
this section to the principal offence is a reference to—
(a) the
offence with which the person released on bail was charged; or
(b)
where that person was charged with a number of offences—that one of the
offences that attracts the highest penalty.
