South Australian Consolidated Acts79—Organisation may be approved (section 77(1))
(1) The Minister, by
notice published in the South Australian Government Gazette, or the National
Director, by notice published in the Commonwealth of Australia Gazette, may,
on application, approve an organisation for the purposes of
section 77(1).
(1a) An application
made to the Minister or the National Director under subsection (1) must
comply with the requirements prescribed by regulation.
(2) In considering
whether to approve an organisation, the Minister or the National Director (as
the case may be) must have regard to—
(a) the
purpose for which the organisation was formed; and
(b) the
extent to which the organisation carries on activities of a medical,
scientific, educational, cultural or artistic nature; and
(c) the
reputation of the organisation in relation to the screening of films; and
(d) the
conditions as to admission of persons to the screening of films by the
organisation.
(3) An approval takes
effect on the date of publication of the notice referred to in
subsection (1).
(4) An approval given
by the Minister or the National Director may be revoked by the Minister or the
National Director (as the case may be) if, because of a change in any matter
referred to in subsection (2), the Minister or the National Director
considers that it is no longer appropriate that the organisation be approved.
(5) The Minister or
the National Director (as the case may be) must notify an organisation in
writing of a decision to revoke an approval.
(6) Revocation of an
approval takes effect on the date of notification of the decision to revoke or
on a later date specified in the notice.
