South Australian Consolidated Acts (1) In proceedings for
an offence, an apparently genuine document purporting to be a certificate, or
copy of a certificate, signed by the National Director, the Deputy of the
National Director or the Convenor and stating that—
(a) a
film, publication or computer game is classified under the Commonwealth Act as
specified in the certificate; or
(b) a
film, publication or computer game is not classified under the Commonwealth
Act, or is not classified under the Commonwealth Act at a classification
specified in the certificate; or
(ba) a
film, publication or computer game was not, at a date specified in the
certificate, classified under the Commonwealth Act or was, at a date specified
in the certificate, classified under the Commonwealth Act at a classification
specified in the certificate; or
(c) an
advertisement described in the certificate is approved under the Commonwealth
Act, or has been refused approval under the Commonwealth Act, or has not been
approved under the Commonwealth Act,
is evidence of, and in the absence of evidence to the contrary is proof of,
the facts stated in it.
(2) In proceedings for
an offence, an apparently genuine document purporting to be a certificate, or
copy of a certificate, signed by the Registrar of the Council and stating
that—
(a) a
film, publication or computer game is classified under Part 3 of this Act as
specified in the certificate; or
(b) a
film, publication or computer game is not classified under Part 3 of this Act,
or is not classified under Part 3 of this Act at a classification specified in
the certificate; or
(ba) a
film, publication or computer game was not, at a date specified in the
certificate, classified under Part 3 or was, at a date specified in the
certificate, classified under Part 3 at a classification specified in the
certificate; or
(c) an
advertisement described in the certificate is approved under Part 3 of this
Act, or has been refused approval under Part 3 of this Act, or has not been
approved under Part 3 of this Act,
is evidence, and in the absence of evidence to the contrary is proof of, the
facts stated in it.
