South Australian Consolidated Acts6A—Functions and powers of Commission
(1) The Commission has
(in addition to the Commission's functions and powers under the Essential
Services Commission Act 2002 )—
(a) the
licensing, price regulation and other functions and powers conferred by this
Act; and
(b) if
the Commission is appointed under the National Electricity Rules as the body
to perform or exercise certain functions and powers—those functions and
powers; and
(c) any
other functions and powers conferred by regulation under this Act.
(2) If electricity
entities are required by licence condition to participate in an ombudsman
scheme, the Commission must, in performing licensing functions under this Act,
liaise with the ombudsman appointed under the scheme.
(3) Without limiting
subsection (1), the Governor may, by regulation, confer functions and
powers on the Commission, or vary the functions and powers of the Commission,
as the Governor considers necessary or expedient for the purposes of the
National Electricity (South Australia) Law and the National Electricity Rules.
(4) In performing
functions under this Act, the Commission must (in addition to having regard to
factors specified in this Act or the Essential Services Commission
Act 2002 ) have regard to the provisions of the National Electricity
Rules and the need to avoid duplication of, or inconsistency with, regulatory
requirements under the Rules.
