FISHERIES (VALIDATION OF ADMINISTRATIVE ACTS) ACT 2002 - SECT 3

3—Validation of certain administrative acts and payments

        (1)         Anything done or omitted to be done prior to 17 September 2001 in or with respect to the variation of conditions of fishery licences relating to matters prescribed by—

            (a)         regulation 14 or 15 of the Scheme of Management (Blue Crab Fishery) Regulations 1998 (see Gazette 11 June 1998 p. 2519); or

            (b)         regulation 14A or 14B of the Scheme of Management (Marine Scalefish Fisheries) Regulations 1991 (see Gazette 27 June 1991 p. 2187),

as in force from time to time is, to the extent of any invalidity, to be taken to have been validly done or validly omitted to be done, as the case may require.

        (2)         Any amount paid prior to 27 June 2001 purportedly as a renewal fee or an instalment of a renewal fee under—

            (a)         regulation 8 and Schedule 2 of the Scheme of Management (Blue Crab Fishery) Regulations 1998 (see Gazette 11 June 1998 p. 2519); or

            (b)         regulation 8 and Schedule 2 of the Scheme of Management (Marine Scalefish Fisheries) Regulations 1991 (see Gazette 27 June 1991 p. 2187),

as in force from time to time is to be taken to have been the correct amount payable as a renewal fee or an instalment of a renewal fee under those provisions.
