South Australian Consolidated Acts6—Procedural powers of the Commissioner
(1) The Commissioner
may, for the purposes of proceedings before the Commissioner—
(a) by
summons, require the attendance of a person before the Commissioner at a time
and place specified in the summons; or
(b) by
summons, require the production of any relevant equipment or other item, or
any relevant books, papers or documents; or
(c)
inspect any equipment, item, books, papers or documents so produced, retain
them for such reasonable period as the Commissioner thinks fit and, in the
case of books, papers or documents, make copies of any of them or of any of
their contents; or
(d)
require any person appearing before the Commissioner to make an oath or
affirmation to answer truthfully all questions put by the Commissioner; or
(e)
require any person appearing before the Commissioner to answer any question
put by the Commissioner or by a person appearing before the Commissioner.
(2) Subject to this
section, a person who—
(a)
having been served with a summons to appear before the Commissioner, fails,
without reasonable excuse, to attend in obedience to the summons; or
(b)
having been served with a summons to produce equipment or other items, or
books, papers or documents, fails, without reasonable excuse, to comply with
the summons; or
(c)
refuses to be sworn or to affirm, or to answer any relevant question when
required to do so by the Commissioner,
is guilty of an offence.
Maximum penalty: $10 000 or imprisonment for 6 months.
(3) A person who
appears as a witness before the Commissioner has the same protection as a
witness in proceedings before the Supreme Court.
