South Australian Consolidated Acts85A—Destruction of fingerprints
(1) This section
applies—
(a) to
fingerprints taken under section 19, 28 or 42 in connection with an
application for a licence, consent or approval if the application is refused;
or
(b) to
fingerprints taken under section 19, 28 or 42 in connection with an
application for a licence, consent or approval if the application is granted
and—
(i)
in the case of a licence—the licence is revoked or
surrendered, or the holder, being a body corporate, dissolved; or
(ii)
in the case of an approval—the approval is revoked.
(2) A person whose
fingerprints have been taken for the purposes of this Act may, if the
fingerprints are fingerprints to which this section applies, apply to
the Commissioner of Police to have the fingerprints, and any copies of the
fingerprints, destroyed.
(3) The Commissioner
of Police may grant or refuse the application as the Commissioner of Police
sees fit.
