South Australian Consolidated Acts23—Saving of proceedings under other Acts or at common law
(1) Nothing in this
Act shall prevent any person from being indicted for any act or omission
constituting an offence against this Act, or from being liable for any such
act or omission under any other Act, or otherwise, to any other or higher
penalty or punishment than that provided by this Act: Provided that no person
shall be punished twice for the same offence.
(2) If the court
before which a person is charged with an offence under this Act is of opinion
that proceedings ought to be taken against such person for such offence under
some other Act, or otherwise, such court may adjourn the hearing of the case
to enable such proceedings to be taken, and such proceedings may thereupon be
taken.
