contravenes a condition
(1) If a person
contravenes or fails to comply with a condition or restriction specified in a
permit or exemption granted under this Act, the permit or exemption does not,
while the contravention or non-compliance continues, operate in that person's
favour.
(2) Where, by virtue
of subsection (1), a person is guilty of an offence against the provision
of this Act from which the person was exempted by the permit or exemption, the
person may be proceeded against either for that offence or for the offence of
contravening, or failing to comply with, a condition or restriction of the
permit or exemption.
