South Australian Consolidated Acts10D—Ascertainment of value of debt
(1) Subject to
subsection (2) of this section, where it is necessary for the purpose of
assessing duty under this Act to ascertain the value of a debt (whether or not
the debt, or the value of the debt, is included in the dutiable estate of the
deceased person) the value shall be ascertained as if the outstanding amount
of the debt had become due and payable immediately before the death of the
deceased person.
(2)
Subsection (1) of this section does not apply in relation to—
(a) a
marketable security; or
(b) a
debt, the terms and conditions of which are such as would, in the opinion of
the commissioner, be expected in a normal commercial transaction.
