South Australian Consolidated Acts39—Power to require evidence of age
(1) If an
authorised person suspects on reasonable grounds that a person seeking to
obtain a tobacco product may be a child, he or she may require the person to
produce evidence, to his or her satisfaction, of the person's age.
(2) A person
who—
(a)
fails, without reasonable excuse, to comply with a requirement under this
section; or
(b)
makes a false statement, or produces false evidence, in response to such a
requirement,
is guilty of an offence.
Maximum penalty: $200.
Expiation fee: $75.
(3) In this
section—
"authorised person" means—
(a) a
person who holds a licence under Part 2 or an employee of such a person; or
(b) an
authorised officer.
