South Australian Current Acts South Australian Current Acts40—Vicarious liability of employers in certain circumstances
If a person commits an offence against this Act in the course of employment by
another, the employer is guilty of an offence and liable to the same penalty
as is prescribed for the principal offence unless it is proved that the
employer could not by the exercise of reasonable diligence have prevented the
commission of that offence.
