South Australia Bail Regulations 2000 under the Bail Act 1985 Contents 1 Short title 2 Commencement 3 Revocation 4 Interpretation 5 Forms 6 Section 13 statement Schedule 1--Forms Schedule 2--Section 13 statement Legislative history 1--Short title These regulations may be cited as the Bail Regulations 2000. 2--Commencement These regulations will come into operation on the day on which Part 3 of the Statutes Amendment and Repeal (Justice Portfolio) Act 1999 comes into operation. 3--Revocation The Bail Regulations 1987 (see Gazette 30.7.1987 p286) are revoked. 4--Interpretation (1) In these regulations-- Act means the Bail Act 1985. (2) In these regulations, a reference to a form of a particular number is a reference to the form of that number set out in Schedule 1. 5--Forms (1) The forms set out in Schedule 1 are prescribed for the purposes of the Act. (2) Subject to these regulations, a form set out in Schedule 1 must-- (a) be used for the purposes specified in the Schedule; and (b) contain the information required by, and be completed in accordance with, the instructions contained in the forms. (3) Form 2 (Written record of reasons for refusal of bail application) is not required to be used if the bail authority refusing bail is a judge of the Supreme Court or the District Court. (4) If an application for review of a decision of a bail authority is made to the Supreme Court, the application must be made in accordance with the rules of the Supreme Court, instead of using Form 6 (Application for review of bail by magistrate). 6--Section 13 statement (1) For the purposes of section 13(1)(b)(i) of the Act, a written statement explaining how, and to what authorities, an application for release on bail may be made under the Act must be in the form set out in Schedule 2. (2) If it appears that the native language of an applicant for bail is a language other than English, the written statement may be in the form of a translation into that other language of that form.
