South Australian Consolidated Regulations39—Assessment in respect of Building Rules referred to the council
If a council is a relevant authority pursuant to section 34(2) of the Act,
then, despite any other provision of these regulations, the council must not
give its decision in respect of the assessment against the Building Rules
until the Development Assessment Commission or the regional development
assessment panel (as the case may be) has made its decision in respect of the
assessment of the development against the provisions of the relevant
Development Plan (but then, if the council grants building rules consent, the
council may also, if it is appropriate for it to do so, issue a notice of
approval under Part 8 of these regulations).
