South Australian Consolidated Regulations93B—Person must avoid conflict of interest as a private certifier
(a) act
for a council in relation to a development if the person has acted as a
private certifier in relation to the same development; or
(b) act
as a private certifier in relation to a development in the area of a council
if—
(i)
the person has acted for the council in relation to the
same development; or
(ii)
the person has an agreement with the council to provide
professional advice to the council on an ongoing basis for the purposes of
section 101(2) of the Act.
Maximum penalty: $4 000.
(2) For the purposes
of subregulation (1), a person acts for a council if the person—
(a)
provides professional advice to the council for fee or reward; or
(b)
represents the council for fee or reward.
