South Australia Libraries Regulations 1998 under the Libraries Act 1982 Contents Part 1--Preliminary 1 Short title 4 Interpretation 4A Acting with approval of Board or authorised officer Part 2--Behaviour on library premises 5 Behaviour of persons on library premises 6 Use of library computers 7 Removal of animals 8 Board may issue temporary ban on person entering library premises Part 3--Parking and traffic 9 Motor vehicles etc 10 Parking permits 11 Bicycles, skateboards etc Legislative history Part 1--Preliminary 1--Short title These regulations may be cited as the Libraries Regulations 1998. 4--Interpretation In these regulations, unless the contrary intention appears-- the Act means the Libraries Act 1982; library premises means a library or a branch of a library that is under the control of the Board and includes any adjacent land or structures that are vested in or under the control of the Board. 4A--Acting with approval of Board or authorised officer (1) These regulations do not prevent a person from doing anything with the approval of the Board or an authorised officer or otherwise with lawful authority. (2) An approval given by the Board or an authorised officer for the purposes of these regulations-- (a) must be in writing or, if given orally, must be confirmed in writing as soon as practicable; and (b) may relate to a particular person or matter or persons or matters of a class specified by the Board or authorised officer; and (c) may be subject to conditions (including a condition requiring payment of a fee) specified by the Board or authorised officer; and (d) may be varied or revoked by the Board or authorised officer at any time. (3) If the Board or an authorised officer gives approval subject to a condition, the person to whom the approval is given must not contravene or fail to comply with the condition. Maximum penalty: $200. Part 2--Behaviour on library premises 5--Behaviour of persons on library premises (1) A person must not, while on library premises-- (a) interfere with another person's reasonable enjoyment of the premises; or (b) smoke or consume any food or beverages (other than in accordance with signs erected with the authority of the Board); or (c) deposit litter or waste matter in any place (other than a receptacle provided for that purpose); or (d) distribute any printed matter; or (e) erect a sign; or (f) offer any article for sale; or (g) take up a collection. Maximum penalty: $200. (2) A person must not bring onto library premises-- (a) an animal other than a guide dog; or (b) library materials, or a bag, case, box or other article that could conceal library materials. (3) A person who needs the assistance of a guide dog may bring the dog onto library premises if at all times it is restrained on a lead not exceeding three metres in length. 6--Use of library computers A person must not use a computer that is the property of the Board and is situated on library premises-- (a) to transmit any material that is defamatory, obscene or offensive; or (b) to knowingly access obscene material. Maximum penalty: $200. 7--Removal of animals An authorised officer may remove any animal from library premises or a part of library premises if the owner or person in charge of the animal cannot be located in the vicinity after reasonable attempts to do so. 8--Board may issue temporary ban on person entering library premises (1) If the Board-- (a) has reasonable cause to suspect that a person has committed an offence against the Act or these regulations; and (b) is of the opinion that it would be desirable to exercise the powers conferred by this regulation in order to prevent the commission of further offences, the Board may, by notice in writing to the person, ban the person from entering specified library premises, or a specified part of library premises, for any period specified in the notice (not exceeding two years). (2) The Board must not issue a notice to a person under this regulation unless the person has been afforded a reasonable opportunity to make submissions to the Board on the matter (either orally or in writing), and the Board has considered any submissions so made. (3) A person who enters library premises in contravention of a notice issued under this regulation is guilty of an offence. Maximum penalty: $500. Part 3--Parking and traffic 9--Motor vehicles etc (1) A person must not drive, ride, park or leave standing a motor vehicle on library premises except in an area that is set aside for that purpose. Maximum penalty: $100. Expiation fee: $25. (2) A person who drives or rides a motor vehicle on library premises must obey any speed restriction, traffic control sign or parking control sign displayed on the premises. Maximum penalty: $100. Expiation fee: $25. 10--Parking permits (1) The Board may delineate, by signs or pavement markings or a combination of signs and markings, an area on library premises as an area in which vehicles displaying a permit issued by the Board may be parked. (2) A person must not park a vehicle in an area delineated under this regulation as an area in which vehicles displaying a permit issued by the Board may be parked unless-- (a) a valid permit is displayed in the vehicle; and (b) the vehicle is parked in accordance with the terms of that permit. Maximum penalty: $100. Expiation fee: $25. 11--Bicycles, skateboards etc (1) A person must not ride a bicycle, scooter, skateboard, roller-skates, in-line skates or similar device on library premises. Maximum penalty: $100. Expiation fee: $25. (2) Subregulation (1) does not apply to a device used to assist a person with a physical impairment.
