South Australia Prices Regulations 2001 under the Prices Act 1948 Contents 1 Short title 3 Interpretation 4 Prohibition on compensation to retailer for unsold bread 5 Prohibition on return of unsold bread Legislative history 1--Short title These regulations may be cited as the Prices Regulations 2001. 3--Interpretation In these regulations-- bread means a food product in the form of a loaf, roll, bun or other piece made by baking leavened dough prepared from flour, water and yeast or other leavening agent, with or without other ingredients. 4--Prohibition on compensation to retailer for unsold bread (1) A person must not enter into a transaction to which this regulation applies or do anything pursuant to such a transaction (whether entered into before or after the commencement of this regulation). Maximum penalty: $750. (2) This regulation applies to an agreement, arrangement or understanding under which a person-- (a) is to supply bread for sale by retail; or (b) is to purchase bread for sale by retail, and financial relief or compensation is to be directly or indirectly given or received in respect of any bread that, having been supplied for sale by retail, is not sold by retail. 5--Prohibition on return of unsold bread (1) Subject to subregulation (2), if bread supplied for sale by retail is not sold by retail-- (a) the supplier of the bread must not take back the bread or cause, suffer or permit another to take back the bread on the supplier's behalf; and (b) the retailer of the bread must not return the bread to the supplier or cause, suffer or permit the bread to be returned to the supplier or to be delivered to another on the supplier's behalf, whether or not financial relief or compensation is directly or indirectly given or received in respect of that bread. Maximum penalty: $750. (2) Subregulation (1) does not apply if the bread is returned because it does not conform to the type or quality for which the retailer contracted with the supplier.
