South Australia Roxby Downs (Local Government Arrangement) Regulations 1997 under the Roxby Downs (Indenture Ratification) Act 1982 Contents 1 Short title 2 Commencement 3 Revocation 4 Interpretation 5 General powers of the council 6 Administrator to act in name of council 7 Proclamation providing for certain matters Legislative history 1--Short title These regulations may be cited as the Roxby Downs (Local Government Arrangement) Regulations 1997. 2--Commencement These regulations will come into operation on the day on which they are made. 3--Revocation The following regulations are revoked: (a) the Roxby Downs (Local Government Arrangement) Regulations 1986; (b) the Roxby Downs (Constitution of Council) Regulations 1986. 4--Interpretation In these regulations-- Act means the Roxby Downs (Indenture Ratification) Act 1982; Administrator means the Administrator of the municipal council appointed under the Act and the Indenture; municipal council means the Municipal Council of Roxby Downs constituted by proclamation pursuant to the Local Government Act 1934 and the Act. 5--General powers of the council The municipal council-- (a) continues as a body corporate with perpetual succession and a common seal; and (b) is capable in its corporate name of acquiring, holding, dealing with and disposing of real and personal property; and (c) is capable of acquiring or incurring other rights or liabilities and of suing and being sued in its corporate name. 6--Administrator to act in name of council The Administrator will exercise all the powers and discharge all the functions of the municipal council in the name of and on behalf of the council. 7--Proclamation providing for certain matters (1) The Governor may, by proclamation made before the expiration of the administration of the municipal council by the Administrator under the Indenture-- (a) determine whether the council is to have a mayor or a chairperson; and (b) determine the number of councillors who are to constitute, or to be included in, the membership of the council; and (c) divide the area of the council into wards; and (d) determine the boundaries of each ward, the name of each ward, and the number of councillors to be elected for each ward (which number may vary from ward to ward); and (e) determine whether the membership of the council is to include aldermen and, if so, how many; and (f) appoint, or provide for the election of, the first members of the council. (2) Section 14(1) of the Local Government Act 1934 will not apply to a proclamation under subregulation (1). (3) A proclamation under subregulation (1) will have effect from the expiration of the administration of the municipal council by the Administrator under the Indenture.
