South Australian Consolidated Regulations4—Consultation with LGA in relation to Board appointments
For the purposes of section 9(4) of the Act, the Minister is to consult the
LGA in relation to the selection of persons for appointment to the Board as
follows:
(a) when
appointments are to be made to fill 1 or more vacancies, an invitation is to
be extended to the LGA to recommend suitable candidates within a specified
period;
(b) the
invitation is to specify the number of persons to be appointed and invite the
LGA to recommend a number of suitable candidates equal to twice the number of
persons to be appointed plus 1 and to recommend, as far as practicable, equal
numbers of men and women;
(c) the
invitation may specify areas of practical knowledge and experience listed in
section 9(6) of the Act required of candidates and, if it does so, a
recommendation of a candidate is to be accompanied by information about the
knowledge and experience of the candidate;
(d) if
the Minister proposes that none of the candidates recommended by the LGA in
response to an initial invitation be appointed, 1 further invitation to make
recommendations is to be extended to the LGA in accordance with this
regulation;
(e) the
period allowed for recommendations is to be—
(i)
for an initial invitation—at least 6 weeks;
(ii)
for a further invitation—at least 2 weeks;
(f) the
Minister is to inform the LGA of persons selected for appointment to the
Board, and invite the LGA to comment on the selection within a specified
period (being at least 2 weeks);
(g) the
Minister is to have regard to recommendations and comments of the LGA made in
response to an invitation under this regulation.
