land—exemptions (section 103M)
(1) A person is exempt
from the application of section 103M(2) of the Act if the person enters
or does anything on land on behalf of the occupier of the land in order to
carry out—
(a) the
requirements of a site contamination assessment order or site remediation
order that has been issued to the occupier; or
(b) a
voluntary site contamination assessment proposal or voluntary site remediation
proposal that has been approved by the Authority on the application of the
occupier.
(2) A person is exempt
from the application of section 103M(3) of the Act if the person enters
or does anything on land on behalf of the owner of the land in order to carry
out—
(a) the
requirements of a site contamination assessment order or site remediation
order that has been issued to the owner; or
(b) a
voluntary site contamination assessment proposal or voluntary site remediation
proposal that has been approved by the Authority on the application of the
owner.
