9—Substance not complying with particulars
(1) A person shall not
sell, offer for sale, expose for sale or have in his possession for the
purpose of sale any substance in a package having affixed thereto a copy of a
registered label if in any respect the substance does not comply with the
particulars stated in such copy or the registered additional particulars.
Penalty:
if the offender is a body corporate—$40 000; or
if the offender is a natural person—$20 000.
(2) In proceedings for
an offence against subsection (1) of this section, it shall be a defence
that—
(a) the
substance was contained in the package and the copy of the registered label
was affixed thereto at the time the defendant acquired the substance; and
(b) the
defendant believed on reasonable grounds that the substance complied in every
respect with the particulars.
