South Australian Repealed ActsThis legislation has been repealed.
(1) The Minister may,
by notice published in the Gazette, exempt any person or class of persons from
any specified provisions of this Act.
(2) Subject to this
section, an exemption under this section may be made subject to such
conditions as the Minister thinks fit and specifies in the notice.
(3) The Minister may,
if he or she thinks fit, by notice published in the Gazette, vary or revoke an
exemption or a condition of an exemption under this section or impose a
further condition.
(3a) If a proposed
exemption, or variation of an exemption or condition of an exemption, under
this section is to apply in respect of the River Murray, the Minister must,
before making his or her decision on whether to grant or vary an exemption or
condition of an exemption, consult the Minister to whom the administration of
the River Murray Act 2003 is committed.
(3b) If a proposed
exemption, or variation of an exemption or condition of an exemption, under
this section is to apply in respect of the Adelaide Dolphin Sanctuary, the
Minister must, before making his or her decision on whether to grant or vary
an exemption or condition of an exemption, consult with and have regard to the
views of the Minister for the Adelaide Dolphin Sanctuary.
(4) A person to whom
an exemption under this section applies must not contravene, or fail to comply
with, a condition of the exemption.
Penalty: Division 6 fine.
Expiation fee: Division 7 fee.
