66—Additional penalty based on value of fish taken unlawfully
(1) Where a person is
convicted of an offence against this Act involving fish taken in contravention
of this Act, the court must, in addition to imposing any other penalty
prescribed by this Act, impose a penalty equal to—
(a) five
times the amount determined by the convicting court to be the wholesale value
of the fish at the time at which the offence was committed; or
(b)
$30 000,
whichever is the lesser amount.
(2) For the purposes
of subsection (1), a fish taken in contravention of this Act is be taken
to have a wholesale value equivalent to that of a fish of the same species
taken not in contravention of this Act.
