(1) This Act binds the
Crown in right of the State and also, so far as the legislative powers of the
State extend, in all its other capacities.
(2) In particular,
this Act, insofar as it applies to the safe construction, maintenance and
operation of railways, applies to any such construction, maintenance and
operation carried out by the Australian National Railways Commission, the
National Rail Corporation Limited, TransAdelaide or other government agency or
instrumentality, or otherwise carried on by the State, the Commonwealth or
another State.
(3) No criminal
liability attaches to the Crown itself (as distinct from its agents,
instrumentalities, officers and employees) under this Act.
