64—Duty to maintain confidentiality
(1) Subject to
subsection (2), an officer or employee of the Department, a person
employed by an employing authority under this Act, or a person working at an
incorporated hospital or an incorporated health centre under any other
arrangement, must not divulge personal information relating to a patient
obtained in the course of employment or while so working except to the extent
that he or she may be authorised or required to divulge that
information—
(a) by
law; or
(b) by
the Department or the employing authority; or
(c) in
the case of a person employed or working at an incorporated hospital or an
incorporated health centre—by the relevant hospital or health centre.
Maximum penalty: $10 000.
(2) This section does
not prevent a person from divulging statistical or other information that
could not reasonably be expected to lead to identification of patients to whom
it relates.
