DEVELOPMENT REGULATIONS 1993 - REG 8

8—Complying development

        (1)         Pursuant to section 35 of the Act (but subject to subregulation (3)), any form of development specified in Part 1 of Schedule 4 is a complying development in respect of a Development Plan.

        (1a)         A provision in a Development Plan cannot affect the classification of a form of development as complying development under these regulations.

        (2)         Pursuant to section 36 of the Act (but subject to subregulation (3)), any form of building work specified in Part 2 of Schedule 4 is declared to comply with the Building Rules.

        (3)         No development which affects a State heritage place can constitute a complying development in respect of a Development Plan or building work that complies with the Building Rules.
