70A—Duration of certificate of competency of a class appropriate to a
trading vessel
(1) Subject to the
Act, a certificate of competency of a class appropriate to a trading vessel
issued after the commencement of this regulation remains in force for five
years after the date of its issue and may be re-validated from time to time
for further periods of five years.
(2) Subject to this
regulation, a certificate of competency of a class appropriate to a
trading vessel issued before the commencement of this regulation remains in
force until cancelled.
(3) The holder of a
certificate of competency of a class appropriate to a trading vessel issued
before the commencement of this regulation is not required to apply for
re-validation of the certificate but, if such an application is made after the
commencement of this regulation, the following rules apply:
(a) if
the application is successful—the certificate ceases to be in force five
years after the date of its re-validation but may be re-validated from time to
time for further periods of five years;
(b) if
the application is refused—the certificate ceases to be in force when
the time for appealing against the decision to refuse the application expires
or, if there is such an appeal, when the decision is confirmed on appeal or
the appeal is discontinued.
