HARBORS AND NAVIGATION REGULATIONS 1994 - REG 74A

74A—Issue of temporary Boat Operator's Licence

        (1)         The CEO may issue a temporary Boat Operator's Licence to an applicant for a Boat Operator's Licence, pending full determination of the application, if satisfied that—

            (b)         the application for a Boat Operator's Licence has been properly made in accordance with this Part; and

            (c)         the applicant satisfies the requirements specified in regulation 66(1) and the CEO is not aware of any reason for believing that the applicant is not a fit and proper person to hold a Boat Operator's Licence.

        (1a)         A temporary Boat Operator's Licence may be issued subject to such conditions as the CEO thinks fit.

        (1b)         If the holder of a temporary Boat Operator's Licence contravenes or fails to comply with a condition of the Licence, he or she is guilty of an offence.

Maximum penalty: $750.

Expiation fee: $105.

        (2)         A temporary Boat Operator's Licence remains in force—

            (a)         for a period of one month; or

            (b)         until the application for a Boat Operator's Licence is determined,

whichever is the lesser period.
