South Australian Repealed RegulationsThis legislation has been repealed.
(1) If a person makes
a statement that is false or misleading in a material particular in an
application, record or return made or lodged under the Act or these
regulations, the person is guilty of an offence.
(2) If a person
contravenes, or fails to comply with a provision of these regulations, the
person is guilty of an offence.
(3) It is a defence to
a charge under these regulations if the person charged establishes—
(a) that
the contravention was due to a reasonable mistake; or
(b) that
the contravention was due to reasonable reliance on information supplied by
another person; or
(c)
that—
(i)
the contravention was due to the act or default of
another person, to an accident or to some other cause beyond the control of
the person charged; and
(ii)
the person charged took reasonable precautions and
exercised due diligence to avoid the contravention.
