(1) The Minister, on advice of an inspector, may(a) grant a licence; or(b) refuse to grant a licence.(2) The Minister may only grant a licence to an institution if satisfied that the institution has an Animal Experimentation Ethics Committee constituted in accordance with the Code of Practice approved under section 34 .(3) A licence is granted subject to the following conditions:(a) that any animal research is not to commence until it is approved by the Animal Experimentation Ethics Committee;(b) that any animal research is to be conducted in accordance with the Code of Practice;(c) that the licensed institution is to be inspected at regular intervals and at least once in every 12 months to ensure compliance with the conditions of the licence;(ca) that the licensed institution is to advise an inspector of the date, nature and result of any external review of the compliance by the institution with the Code of Practice;(d) any other condition the Minister considers appropriate or necessary.(4) A licensed institution must comply with the conditions specified in subsection (3) .Penalty: Fine not exceeding 500 penalty units.(5) A licence is to be (a) granted in the name of the institution making the application; and(b) in a form approved by the Minister.
