Tasmanian Numbered Acts309. Requirements before application can be made
(1) Before an application is made under section 308, the cooperative must, by special resolution passed by means of a special postal ballot
(a) approve the proposed application; and
(b) determine under what name the cooperative is to apply to be incorporated or registered; and
(c) adopt any memorandum or articles of association or constitution or replaceable rules or rules that may be necessary or considered desirable.
(2) The name applied for need not be the same as that of the cooperative and must not include the word "cooperative" or any other word importing a similar meaning.
(3) The Commissioner may, by order, exempt a cooperative from compliance with all or specified provisions of this section and section 199 in relation to any matter to which this section applies.
(4) An exemption under
subsection (3) may be granted unconditionally or subject to conditions.
