COOPERATIVES ACT 1999 (NO. 85 OF 1999) - SECT 419

419. Fraud or misappropriation

      (1) A person must not –

(a) by false representation or imposition, obtain possession of any property of a cooperative; or

(b) having any property of a cooperative in his or her possession, withhold or misapply it or wilfully apply any part of it to purposes other than those authorised by the rules of the cooperative or by this Act.

Penalty:

Fine not exceeding 60 penalty units.

      (2) A person who is found guilty of an offence under subsection (1) must, if ordered to do so by the court, deliver up all such property and repay all money improperly applied.

Penalty:

Fine not exceeding 60 penalty units or imprisonment for a term not exceeding 6 months, or both.
