EVIDENCE ACT 2001 (NO. 76 OF 2001) - SECT 14

14. Compellability: reduced capacity

A person is not compellable to give evidence on a matter if the court is satisfied that –

(a) substantial cost or delay would be incurred in ensuring that the person would be capable of hearing or understanding, or of communicating replies to, questions on that matter; and

(b) adequate evidence on that matter has been given, or will be able to be given, from another person or source.
