Part 4, Division 1AA repealed [crest] Gas Amendment Act 2008 An Act to amend the Gas Act 2000 [Royal Assent 17 April 2008] Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Gas Amendment Act 2008. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. 3. Principal Act In this Act, the Gas Act 2000 is referred to as the Principal Act. 4. Section 3 amended (Interpretation) Section 3(1) of the Principal Act is amended as follows: (a) by omitting "supply" from the definition of "distribution system" and substituting "delivery"; (b) by omitting the definition of "gas" and substituting the following definition: "gas" means (a) natural gas; or (b) liquefied petroleum gas; or (c) any other gaseous fuel, being a gaseous fuel that is not declared by the regulations to be excluded from the operation of this Act; (c) by omitting "supply" from paragraph (b) of the definition of "gas supply point" and substituting "delivery"; (d) by omitting paragraph (c) from the definition of "gas supply point" and substituting the following paragraphs: (c) if paragraphs (a) and (b) do not apply, the point of delivery of gas between (i) a pipeline that is declared, or belongs to a class of pipelines that is declared, under section 3(3) of the Gas Pipelines Act 2000 to be treated as a transmission pipeline for the purposes of that Act; and (ii) the person to whom the gas is delivered; or (d) if paragraphs (a), (b) and (c) do not apply, the outlet of the first stage regulator of a liquefied petroleum gas storage cylinder or tank; (e) by inserting the following definition after the definition of "operations": "person" includes (a) any body of persons, corporate or unincorporate; and (b) any government department or other government body; (f) by omitting "customer's" from the definition of "supply". 5. Part 4, Division 1AA repealed Division 1AA of Part 4 of the Principal Act is repealed.
